Terms of Service

1. Acceptance of Terms
By accessing or using Opal (the “Service”), operated at heyopal.ai, including the DAX conversational trading interface, the MCP server at mcp.heyopal.ai, and any related APIs or tools, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Description of the Service
Opal provides conversational access to Solana market data, portfolio analytics, risk assessment, and trade execution for humans (via the web app) and AI agents (via the Model Context Protocol). The Service is currently in beta and is provided on an “as is” basis. Features, tools, and pricing may change without notice.
3. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction to use the Service. You are responsible for maintaining the confidentiality of your account credentials, API keys, and any wallet signing authorisations you grant, and for all activity that occurs under your account.
You agree to provide accurate information during sign-up (including when authenticating via Google) and to keep it up to date. You may not use the Service if you are located in, or are a resident or national of, any jurisdiction where use of the Service would be unlawful.
4. Financial Risk Disclaimer
The Service is not financial, investment, tax, or legal advice. Trading cryptocurrency assets, including tokens on the Solana network, involves significant risk and may result in the total loss of your capital. Prices can move rapidly, liquidity can disappear, smart contracts can fail, and on-chain transactions are irreversible.
You are solely responsible for any trades executed through the Service, whether initiated by you, by an AI agent acting on your behalf, or by an automated strategy you have configured. You should consult qualified professionals before making any trading or investment decision.
5. Acceptable Use
You agree not to:
- Use the Service to violate any applicable law, regulation, or third-party right.
- Attempt to gain unauthorised access to any part of the Service, other user accounts, or Opal's infrastructure.
- Probe, scan, or test the vulnerability of the Service, or interfere with its integrity or performance.
- Reverse engineer, decompile, or attempt to extract the source code of any non-open component of the Service.
- Use the Service to engage in market manipulation, wash trading, or any activity designed to deceive other market participants.
- Abuse, spam, or overload the API, MCP server, or web interface beyond reasonable limits.
6. Third-Party Services and Wallets
The Service integrates with third parties including Google (for authentication), Solana RPC providers, decentralised exchanges, and external market data sources. Your use of those services is governed by their own terms. Opal is not responsible for the availability, accuracy, or behaviour of third-party services.
When you connect a Solana wallet, you are responsible for the safekeeping of your private keys. Opal does not custody user funds and signs transactions only with the scope you explicitly authorise.
7. Intellectual Property
The Service, including its software, design, content, and branding, is owned by Opal and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use the Opal name, logo, or trademarks except as necessary to use the Service.
8. Beta Service; No Warranty
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. Beta features may contain bugs and may be modified or removed at any time.
9. Limitation of Liability
To the fullest extent permitted by law, Opal and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or trading losses, arising out of or in connection with your use of the Service. Opal's total aggregate liability to you for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the fees you have paid to Opal in the twelve months preceding the claim, or (b) £100.
10. Indemnification
You agree to indemnify and hold harmless Opal, its operators, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful to the Service, other users, or third parties. You may stop using the Service at any time. Provisions which by their nature should survive termination will survive.
12. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will update the “last updated” date at the top of this page and, where appropriate, notify you via the Service or email. Your continued use after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
